Outgoing Extradition Requests

Where a crime is alleged to have occurred in Australia, but the alleged offender is in another country, an outgoing extradition request can be made to bring that person back to Australia to face prosecution or to serve sentence.

The process involves the AFP or other relevant Australian authorities preparing the extradition request. The request needs to include relevant information including the details of the individual, the offence they are facing and the alleged evidence supporting their involvement and the arrest warrant. This allows the receiving country to make an assessment as to the merit in the request and that it complies with international expectations around humane treatment.

The requested country will review the request and may hold an extradition hearing to determine whether the person can be extradited. If the request is granted, the AFP or other Australian authorities will coordinate their return to Australia. Once in Australia, they will be handed over to the relevant authorities to face their charges or serve sentence.
