Possession and Distribution of Child Abuse Material – Broadmeadows

This case study examines a charge of possession and distribution of child abuse material in Broadmeadows. What is alleged to have occurred?

Our client was charged with possession of child abuse material. The offending had been detected when they had uploaded images which constituted child abuse material (CAM) to Google Drive. The material was flagged as being offensive by the service provider. When service providers based in the United States of America become aware that material of this nature is being used on their platform, they are required to notify the National Centre for Missing and Exploited Children. In this case, they were able to determine the potential geographical location of the computer and notify local law enforcement.

Local police were then able to find the email address and phone number associated with the username, which ultimately led to our client, who was the registered user. Police executed a search warrant at our client’s home and seized a number of devices. After conducting a thorough analysis, they located nearly 70 videos and images which constituted CAM. They also found evidence that our client had shared some images with others via a chat room.

What happened at court?

Our client was interviewed by police immediately after the search was executed. They gave a very open and honest explanation of why they had been engaging with that type of material. They expressed great regret and acknowledged it was the wrong thing to do.

They were charged with possession of CAM and distribution of CAM. The matter proceeded as a plea of guilty.

Cases involving charges of this nature are treated very seriously by the courts. The court recognises the harm to the children that are involved in the production and distribution of child abuse material and uses the sentencing process to send a strong message to the community.

When appearing In these cases, it is important to take the time to delve deeply into what led our client to engage with this sort of material. The context and reasons for the offending assist in informing the Magistrate about the level of moral culpability and, importantly, their prospects for rehabilitation.

In this case, our client was aged in their early 20’s at the time of the offending. They sadly did not get the start in life that most young people do. They had unstable parental influence and experienced psychological abuse within the home. Our client became socially withdrawn as an adolescent and teen, finding company and an opportunity for distraction in the online gaming world. Unfortunately, this is also a place where people who are young and emotionally vulnerable can be influenced by predatory behaviour from others.

Over time, these people invited our client into various chat rooms which engaged with illegal and offensive material. Our client was exposed to it for the first time and, in the context of being encouraged by others, had lost perspective on the harmful impact this had on the children who had been exploited and the significant legal ramifications. Our client acknowledged, however, that they were ultimately responsible for their own actions, and this explanation could only take them so far.

Our client presented as a genuinely remorseful young person who had the potential to go on and prosper, if given the opportunity. They were not able to engage in offence-specific treatment ahead of the plea hearing as it was cost prohibitive. They did see a forensic psychologist who was able to offer some insights to the Court about their psychological profile and an opinion about what would assist in reducing their risk of re-offending.

Submissions were made to the Magistrate which emphasised the comparatively low number of images, our client’s lack of prior criminal history, their age and complex context to their involvement in the offending and that they were willing to engage fully in any court-ordered rehabilitative program.

What was the result of the charge of possession of child abuse material in Broadmeadows?

The court was ultimately persuaded that despite the serious nature of the offending, a Community Corrections Order was the appropriate penalty. Our client was also placed on the Sex Offender Register for the mandatory period of 15 years.
