Sexual Misconduct – Broadmeadows

This is a case study on workplace investigation surrounding allegations of sexual misconduct in Broadmeadows. Our client was a social worker in a residential care facility who was accused of engaging in what could be perceived as a grooming behaviour while performing their duties.

What is alleged to have occurred?

It was alleged that our client had engaged in care that was neglectful and failed to care adequately to the extent that a person’s health, wellbeing and development was significantly impaired or at risk. There were claims that the client had engaged in sexual misconduct in that it involved a departure from the acceptable standards as a residential youth worker, which was intentional or seriously negligent and could even be perceived as grooming behaviour. This included an inappropriate conversation that was overly personal, intimate and sexualised.

The organisation were conducting an investigation into the conduct to determine if the allegations were substantiated or not.

What happened following engagement with a lawyer?

Our lawyer commenced by providing advice at an early stage on how to respond to the allegation and the manner in which that response should be delivered to the organisation. It was determined that a comprehensive written response to the allegation was the most appropriate in this case, and was going to be in the client’s best interests despite real pressure from the organisation to participate in a verbal interview. The client’s personal circumstances together with the specific allegations were considered when providing this advice.

A submission was prepared which provided a detailed account from the client about what happened with the young person in question. An analysis of the available evidence, together with its application to the test which needed to be met in order for it to be characterised as misconduct, was made.
