Felony is a term that is mainly used in the United States of America. In Victoria the distinction that is drawn is normally between indictable and summary offences. An indictable offence is a more serious offence and is the equivalent of a felony offence. Generally there are a number of felony type offences that can be heard in the Magistrates’ Court. If it is a more serious felony offence then it will only be able to be heard in higher Courts.

To follow the process and see how an indictable case would be dealt with you can look at our map of the Court process. An indictable matter starts in the Magistrates Court but ends up in the Higher Courts. Follow this useful tour of the Court process to see what is involved in the  committal process
