Maximum Penalty – Exceed prescribed concentration of drugs (drug driving)

Offences involving alcohol or other drugs

For the charge of ‘Exceed prescribed concentration of drugs (drug driving)’, the maximum penalty is:

First Offence: 12 penalty units and a licence disqualification of 6 months

Second Offence: 60 penalty units

Subsequent Offence: 120 penalty units

Note: A person who is guilty of an accompanying driver offence is liable to a fine of not more than 5 penalty units.
