Maximum Penalty – Driving under the influence of intoxicating liquor or of any drug (DUI)

Offences involving alcohol or other drugs

For the charge of ‘Driving under the influence of intoxicating liquor or of any drug (DUI)’, the maximum penalty is:

First Offence: 6 months licence disqualification / 25 penalty units

Second Offence: 12 months licence disqualification / 120 penalty units

Subsequent Offence: 18 months licence disqualification / 180 penalty units

Note: A person who is guilty of an accompanying driver offence is liable to a fine of not more than 5 penalty units.
