Maximum Penalty – Drive While Impaired by Drugs

For anyone found guilty of the charge Drive While impaired by drugs, there are maximum penalties that can be imposed, depending on whether it is a first, second or repeat offence.
There is a maximum penalty of a fine of 12 penalty units for a first offence and a mandatory license disqualification of a period not less than 12 months.

A second offence carries up to 12 months imprisonment and/or a fine of 120 penalty units.

Any subsequent offence carries a maximum penalty of 18 months imprisonment and/or a fine of 180 penalty units.

There is no discretion available for the mandatory license disqualification period. A person who is guilty of an accompanying driver offence is liable to a fine of not more than 5 penalty units.
