Entering a Discontinuance

Was a discontinuance entered? “Entering a discontinuance” (previously known as nolle prosequi) is how the Prosecutors tell the Courts that they have decided to not prosecute your case further.

There is a particular document for discontinuance filed in the County or Supreme Court to indicate that the case is no longer going to proceed.

The entering of a discontinuance does not mean that the case against you can never be restarted. It is not like a jury verdict of not guilty which is the final determination of a case. It is though, incredibly unusual for a person who has had a discontinuance entered against them to face those charges again (and we have never had it happen at our firm).
