It is necessary to file at least one affidavit in support of a bail application. Most commonly that is an affidavit from the solicitor who is looking after your case. They detail the facts of your case and what has happened in relation to previous bail applications in the case. They explain when the previous bail application occurred and the reason it was rejected.
The affidavit in support of a bail application will also have to set out the reasons that it is submitted that granting bail is the appropriate course of action.
There can also be affidavits in support of a bail application from people who are willing to provide accommodation, employment or a surety.
Affidavits in support of a bail application have to be set out in a particular way and ideally need to be drafted by your lawyer.
