He was charged with taking medication from the pharmacies for personal use, and making false entries in the records to conceal his conduct. An anomaly was noticed which then brought his offending into the open. He was arrested by the police and was charged with “Supply Schedule 8 Poison”.

Being a professional person, his primary concern was on whether he would receive a criminal conviction. His employment was terminated as a result of having been charged. There were further consequences from AHPRA (the board which regulates the profession), which meant that he was unable to work in his field until at least the court matters were over. Thereafter there will also be a disciplinary matter that he will need to contend with.

One of the biggest challenges we faced in handling this case was that the offending was protracted, over a number of pharmacies, and involved many instances. Kristina considered it important that the court fully appreciate the reason why the client commenced offending in this way. He had been going through personal difficulties that he was not able to address through counselling and so he sought to medicate himself. The medication he used was addictive, and a cycle commenced which he could not get out of.

Our client’s arrest eventually acted as a catalyst for change. He engaged with professional supports and had got back on track. The submissions were substantiated with material from his treaters and some very impressive character references. Ultimately, the magistrate was persuaded to deal with the matter without conviction. The client was fined by way of instalments but no conviction was recorded.

This was a good outcome – without conviction for making false entries in record and all other charges – especially taking into consideration our client’s professional reputation.
