Traffic Offences, Appeal to County Court
On a plea of guilty to Exceed PCA, Drive in a manner Dangerous, and Drive whilst license disqualified, the Magistrate had imposed a period of 6 months immediate imprisonment. This case was heard at the Broadmeadows Magistrates’ Court.
Shaun Pascoe acted in behalf of our client. By marshalling material not placed before the sentencing magistrate, and by calling character evidence from our client’s sister, Shaun was able to persuade a County Court Judge to overturn the Magistrate’s sentence. Our client did not serve 6 months imprisonment. He was placed on a 4-month Intensive Corrections Order and was thus permitted to remain in the community.
