Sentence Appeal – Drug Charges
This is a case study on a sentence appeal for drug charges.
Our client had an extremely long criminal history (over 30 pages). He had been initially represented by another firm in the Magistrates’ Court and had pleaded guilty to possessing a drug of dependence and committing an indictable offence while on bail. He was sentenced to 28 days imprisonment.
The client then filed an appeal against the sentence and we appeared for him for this appeal at the Melbourne County Court. Overall the charges involved were:
Submissions were made to the sentencing judge and documents were tendered. Her Honour eventually set aside the order of the Magistrates’ Court and ordered the client to pay $500, ultimately making this a successful sentence appeal for drug charges.
