Rape and Indecent Act with a Child Under 16 – Wholly Suspended Sentence

Our client was charged with multiple charges of sexual penetration of a child under 16, digital rape, and inciting minor to make child pornography. This last charge involved the client asking the minor to take a naked photograph of herself and send it to him. The relationship was one of coach and student. Our client ran a trial and pleaded not guilty to all of the charges.

Our client was found not guilty of all charges apart from the charge involving a text message. In relation to this charge, the Prosecution was able to produce evidence of phone records indicating origin of the message. A plea was conducted on this single charge and our client was sentenced to 12 months imprisonment which was wholly suspended for 24 months. He was also placed on the Sex Offender Registry for a period of 8 years.
