Rape, Appeal for a Trial – Successful Appeal, Not Guilty

What is alleged to have occured?
The client had been charged with rape and indecent assault on his then partner. The rape was said to have occurred during the course of their relationship. The client, with his former solicitors, ran a trial in the Melbourne County Court, where he was found guilty. He came to us to conduct an Appeal in the Court of Appeal on a point of law.

What happened at court?
Kristina Kothrakis acted on behalf of the client. We were successful in the appeal, and a re-trial of his matter was ordered. We worked closely with experienced Counsel in conducting this matter.

What was the result?
Pre-trial evidentiary rulings went in our favour, and the client was found not guilty on both charges after what was a harrowing 3 years awaiting an outcome.
