Diversion for Criminal Damage

Obtaining Diversion for Criminal DamageOur client was drunk and had a fight with his girlfriend and a couple of men in the street. He proceeded to kick and hit a BMW parked in the street, caused a $7K damage, and was charged with one count of Criminal Damage as a result. He gave a no comment record of interview.

He was represented by Doogue + George at the Melbourne Magistrates’ Court

We were successfully able to obtain a diversion for this case. This was made possible by effectively conveying how our client had struggled with alcohol issues and how this was shaped by his family background.

Our client was an Irish citizen on a visa in Australia, hence it is crucial for him to avoid a criminal conviction. We were also able to overcome the hurdle of the client having given a no comment record of interview. Ultimately, along with granting the diversion, the conditions given by the magistrate was that our client repay the victim $550 and donate $450 to charity.
