Exceed PCA and Drive Disqualified – CBO, Fine

What is alleged to have occured?
Our client was charged with Exceed PCA and Drive Disqualified following a road accident that involved a pedestrian. It must be noted that the police attributed the cause of accident to pedestrian negligence; hence our client was found not culpable for the accident.

This was the client’s second drink driving offence and the first offending occurred within the last 3 months. He has also been previously charged for failing to stop at a scene of accident.

What happened at court?
We acted on the client’s behalf at the Heidelberg Magistrates’ Court.

What was the result?
The magistrate imposed a Community-Based Order for a period of 12 months. Our client was also required to complete 75 hours of unpaid community work and to attend a counseling program for alcohol usage as part of the sentence. For the charge of Drive Disqualified, our client was fined $1,000 to be paid within 6 months.
