Our client was a female in her early twenties who came to our office with a history of drug abuse and mental health issues.
Six briefs went before the court for a consolidation including 9 drive whilst suspended charges.
Material was obtained from her treating doctor as well as from a psychologist which she had previously seen and this was put before the Magistrate.
Our client came before the court with no driving history, however with the amount of driving suspended charges that were being plead to, an immediate custodial sentence was within range in terms of sentencing options for the Magistrate as well as a lengthy licence suspension.

Submissions were made in regards to our client’s drug abuse issues and previous treatment with a psychologist. Our client’s prospects for rehabilitation in our submission were great if she were to be afforded the opportunity to complete a sentence within the community through the Office of Corrections.
It was explained to the Magistrate that if our client’s licence was suspended for a lengthy period of time, we would be setting her up to fail, in essence as she relied on her ability to drive to get to her appointments and as a sense of freedom when trying to cope with the symptoms associated with her decline in mental health.
The submission was also put for a non-conviction disposition on the basis that this was the first time, albeit a lengthy number of charges, that our client appeared before the court in relation to driving-related matters.
Ultimately the Magistrate imposed a sentence without conviction of a 12-month treatment only community corrections order. Our clients licence was suspended for a period of 2 months.
