Criminal Damage and Assault Charges – Acquitted
Our client allegedly assaulted and damaged her mother’s property. She was charged with the following:
The matter was contested and went to a contest. It was heard at the Sunshine Magistrates’ Court.
The evidence on initial review was very strong against our client. Both the victim and the independent witness gave evidence that our client assaulted the victim and also smashed the three windows with a weapon.
In cross examination, we were able to discredit both witnesses and we called both our client and her partner to give evidence that contradicted that given by the Prosecution witnesses.
Our client was acquitted of the charges and was also awarded costs by the Magistrate as agreed with the prosecutor.
