Careless Driving – Fine, No Licence Suspension

careless driving fineOur client had got into his car after work. He reversed his car, and at that moment was blinded by bright sunlight. He proceeded to reverse, and while doing so accidentally drove into another parked car where a person was trying to enter her vehicle. She was pinned between her door and her car and broke her pelvis in multiple places. She could not work for three months and required extensive physiotherapy.

The client was charged with Careless Driving.

Kristina Kothrakis provided criminal defence for the accused. The matter proceeded as a plea of guilty to a charge of Careless Driving  and was heard at the Heidelberg Magistrates’ Court.

Due to the level of injury, the matter was quite serious. Our client was incredibly remorseful for his conduct, which was compounded due to the fact that he and the victim are colleagues. He made numerous enquires as to her well-being and reported the matter himself to police. Character reference material was submitted which supported the submissions that were being made.

The magistrate accepted that the collision was caused by a momentary lapse in concentration, made worse due to the bright sunlight which obscured his vision. Our client was concerned about losing his licence. The magistrate was persuaded to deal with the matter by imposing a fine and licence suspension was ordered by the Court.
