Assault Charges in PrisonThis is a case of withdrawing assault charges on basis of self defence.

Our client was in custody and was accused of violent assault against a cell mate. His instruction was that the cell mate was the aggressor and had assaulted him first. Notwithstanding this the police pursued charges against the client and did not accept his version of events.

We acted on the client’s behalf at the Ararat Magistrates’ Court. The charges were:

We successfully got the charges withdrawn. We were able to mount a compelling argument for self-defence and the prosecution agreed to withdraw the charges on that basis.
