Criminal Penalties - Suspended Prison Sentence

A suspended sentence is where you are given a gaol term but you do not have to serve it straight away (e.g. the sentencing Judge or Magistrate will order that you serve 12 months imprisonment suspended for 2 years).

That means you do not go to gaol but you have the sentence hanging over your head for 2 years.

You only have to serve the sentence if you commit another offence during the period of the suspended sentence. If you breach a suspended sentence you have to show "exceptional circumstances" as to why you should not go straight to gaol. "Exceptional circumstances" is a consider a very high threshold to get to by the Courts.
