Criminal Penalties - Suspended Prison Sentence
Criminal Penalties - Suspended Prison Sentence
A suspended sentence is where you are given a prison term but you do not have to serve it straight away (e.g. the sentencing Judge or Magistrate will order that you serve 12 months imprisonment suspended for 2 years).
That means you do not go to prison but you have the sentence hanging over your head for 2 years.
You only have to serve the sentence if you commit another offence during the period of the suspended sentence. If you breach a suspended sentence you have to show "exceptional circumstances" as to why you should not go straight to prison.
"Exceptional circumstances" are considered very hard to establish by the Courts.
To ensure that you receive the lowest possible penalty, contact Doogue & O'Brien on 03 9670 5111.
