Facts of the Case - Sexual penetration, rape child under 16


The accused who was 19 years old went to a party where he met a young woman. After a while they both went into a room and had sex. They exchanged phone numbers and then the accused left. The alleged victim had sex with a number of other boys on that evening.

They were all put on trial together on a charge of sexual penetration of child under 16 years old. There were two trials as in the first one the jury had to be discharged

 

Results Achieved


The accused had made it clear in his interview that she had consented and that she had told him that she was over 16 years old. There was evidence surrounding the events that indicated that his version was truthful.
