Facts of the Case - Possession of child pornogaphy, production of child pornography
Charges of possessing child pornograpy and producing child pornography/downloading child pornography. The allegation was the defendant had downloaded images and that they amounted to child pornography (ie that the girls depicted were under 18 years old.
Results Achieved
The Court accepted that there was a doubt as to the age of the girls in the photographs and that where there is a doubt the charges must be dismissed. The defendant would have been placed on the sex offenders Register as well as other penalties and in the circumstances it was a very rewarding result
