Facts of the Case - Traffick Drug of Dependence x 3, Possess Drug of Dependence


Shaun Pascoe’s client in this matter was charged with multiple drug offences, including trafficking a drug of dependence (amphetamines).  As it was alleged his client was part of a larger drug syndicate, his client’s case was too serious to be heard in the Magistrates Court.

Results Achieved


Shaun was able to successfully negotiate the withdrawal of some of the traffick drug of dependence charges.  As a result, the County Court heard just two charges, Traffick DOD and Possess DOD.   By distinguishing between his client’s role and the role of other co-accused, the absence of similar offending, and the period over which the trafficking was alleged to have occurred, Shaun was able to persuade the County Court Judge to impose a Community Based Order for 18 months with conditions including unpaid community work, supervision, and assessment for drug counselling.
