Facts of the Case - Motor vehicle offences: exceed pca, drive disqualified
Client charged with drink driving and exceed pca. 2nd offence for drink driving. Prior for failing to stop at scene of accident. Circumstances of offence involved a fatal collision with a pedestrian. Police did not allege client culpable for accident. Pedestrian negligence attributed as the cause for collision.
Results Achieved
For 2nd offence of drink driving (within 3 months of first), placed on a Community Based Order for 12 months, to perform 75 hours unpaid community work, further ordered to attend for counseling for alcohol usage.
For offence of drive whilst license disqualified, fined $1000 with a stay of 6 months.
