Facts of the Case - Aggravated Burglary and others


The client was charged with Aggravated Burglary (intention to assault). The charge was too serious to be heard in the Magistrates Court.

Shaun Pascoe appeared in the County Court for a plea of guilty to the above charges. 

Shaun was able to argue against the imposition of an immediate term of imprisonment, by drawing the Court’s attention to the substantial rehabilitation his client was undergoing since the commission date of the offence.

 

Results Achieved


Despite the seriousness of the charge and the circumstances in which the offence was allegedly committed, several charges were withdrawn as the result of pre-hearing negotiations with the Director of Public Prosecutions.  Shaun was able to persuade the Judge to facilitate a sentence which fostered his client’s continued rehabilitation.   

The client received a 15 month wholly suspended sentence in combination with a Community Based Order.
