Is the bail application in the Magistrates' or Children's Court?

BlackMenuBar.jpg, 340B A Bail application in the Magistrates Court and a bail application  in the Childrens' Court are handled very differently to bail applications in the Supreme Court or bail application in the County Court.

These bail applications generally get on much faster and have a lot less procedure surrounding the filing of paperwork etc.

If the court case involves a child and they are in custody then the bail application would be in the
Childrens' Court.  If an adult is charged and the charge is not a murder then the bail application would be in the Magistrates Court.

Obviously you need to speak to a lawyer straight away if you are trying to organize bail for someone. While guides such as this are useful to understand the process they do not replace getting proper legal advice and representation.
